Is the aftercare facility liable?


I developed a huge hematoma after a breast reduction and liposuction surgery earlier this year. You can see a <a href="http://www.surgerysagas.com/2007/0... at this site</a>. The surgery was April 13th and I left the aftercare facility on the 17th. During my stay, I kept telling them that my left armpit was burning. They laughed off my complaint.
I chose this aftercare facility because they billed themselves as a medical facility with nurses who would look after me. When I got home, the burning was still there and worse, so I looked under the bandages and found a huge hematoma. My question, is the aftercare facility liable for not listening, investigating, and finding the hematoma before I was released.
I do not feel that they should have released me that way.

Medical malpractice is always an uphill battle.

You have to prove that the facility was negligent in handling your recovery, and their negligence caused the hematoma.

Sometimes people have symptoms of a burning sensation, and it may be due to latent pain from the surgery, once the meds wear off.

Again, you have an uphill battle.

I would definitely discuss this with a lawyer.
