Is it ILLEGAL in mississippi to cut or burn(CAUTERIZE) a woman's tubes without her asking for it?


I wanna know if theres anyone out there that can help me with some information, I wanna know how can the doctor burn (cauterize) your tubes without you knowing? Shouldnt that be illegal/ I wanted mine tied, but not clipped and burnt!!! I never asked for that to be done, But i spoke to a nurse at the hospital and she told me that that is the only way they do it.. She said they do everyone that way. I don't think that is right, If you asked for your tubes to be tied, then they should only tie them, not cut and burn them!!! I live in mississippi and i wanna know is that legal??? CAN YOU HELP ME PLEASE??

AngieC is the only person who answered this correctly. You gave what's called INFORMED CONSENT. Now let me ask you something: Why in the world would any woman electively undergo a procedure that permanently alters your reproductive organs without researching it first (or ANY surgery for that matter!)? Secondly, if you had even the tiniest inclination to want another pregnancy in the future, why not take another form of birth control?
There isn't a court in the world who would award you a settlement for being stupid. Sorry.

Sounds like a nice lawsuit to me.

you have to give permission to have them cauterized because tying the tubes is reversible but having the tubes cauterized is not. if you can prove that you did not give permission for this (you should have signed documentation) then you have a lawsuit on your hands.

"getting your tubes tied", might just be a kinda "slang" term for saying it, but i don't know for sure, you should try to sue :-)

A tubal-ligation is not meant to be temporary, and if not properly sealed, could result in unwanted pregnancy.

If you ended up with an unwanted pregnancy after believing this procedure was final... your doctors would be held liable, and you would have a case against them. But that's not what happened. They performed the surgery as it is always done, and you fell into a dereliction of duty of your own choices & body by not asking these very important clarifying questions before you underwent surgery.

I've seen a few tubal-ligations performed, as well as vasectomies, and they all get cut & cauterized.

I'm afraid you did not seek or receive the full information regarding this procedure before having it performed on you.

This is something you should have asked for clarification on before you went under. In all cases of elective surgery, you should demand a full explenation of the procedure, or even a walk through step by step. It is your responsibility to demand this information before coming to your decision... and if you assumed that one thing would be done, but did not actually inquire about the procedure before-hand... I'm afraid you dont have a leg to stand on, legally.

If you signed a document authorizing this surgery, without full knowledge of the procedure, I am sorry that you did not have more forthright surgeons, but they can't assume you havent done your own research, and may only have time in their schedules to answer these questions if you bring them up.
They cant assume everybody that comes across their table for an elective, or planned ahead surgery has not done any research... or at the very least, discussed the urge to become pregnant with your doctor... at which point, another form of birth control would be better than tubal ligation.

I'm sorry to be the bearer of bad news... but you waited until too late.

What you really need to do is get a consultation with a Medical Malpractice attorney. Usually asking to get your tubes tied is misinterpreted as taking away your ability to have more children. I'm assuming they didn't explain the procedure before doing it? They usually do but not always. You must have signed some type of consent form, if you aren't a minor, so get a copy of that if you don't have it and take it to an attorney so he can review it. The laws differ in each state and I don't know what your rights are in Mississippi. Usually things like this are the same in each state.

it depends, did you sign for it? it is illegal for them to do that without your knowledge and it should also be illegal for them to mislead you into thinking they were only going to tie your tubs but then burn them, consult a lawyer, they could be sued for malpractice. ALWAYS READ THE FINE PRINT BEFORE YOU SIGN. they are also suppose to give you information pamplet explaining what they do in the procedure.

It is illegal since they didn't inform you about the procedure that they will do unto you. You should talk to an attorney about this..
