Is it legal to exhume his body? |
My grandfather passed away in february. The "step" family has decided that the wishes my aunt carried out are not what he wanted, even though he stated to hospice nurses, ministers, funerl workers etc. this is what he wanted. Can they legally get his body exhumed? And if so what has to happen and what kind of costs has to be paid for this? It is possible to have a body exhumed to have it moved. Every situation is different and I expect that your step family would have to go through a lengthy legal process to have it done. I understand it is costly. I think for the best information you should call the place where he is buried and they can give you more info about local regulations and how it is done and the likelihood that they will be given permission to do it. I believe they have to get a court order. It has to be a good enough reason for the judge to decide to let them do this. I really don't know who has to pay for this. In order for the "step" family to move your grandfather, they would need a court order. Do you know if he left a will? If he did and his wishes are stated in the will, then the chances of his body being exhumed want happen. Please accept my sympathy for your loss. Well, if the family wants to pay for it then they can do whatever they want. People are moved all the time. |
