How do i pursue being terminated after i requested FAMILY LEAVE ACT for my mom whom is on hospice in my home?


im a LVN that was employed at a nursing home. 1 week prior to the termanation an issue of discrimination became a problem.

Ellen, I need more information.

First of all, I would review the Dept. of Labor website to see whether or not FMLA applies.

Second, I would see an employment attorney.

I would tell you more, but then you wouldn't go research it for yourself, and I don't want you relying on internet information for what is a real legal problem.

Lawsuit time..get a lawyer that specialized in workplace issues. Sounds like an easy case to win. I bet that your employer is betting that you don't have the balls to sue them.

in my state they can fire you for tying your shoes wrong

How is your record with them? Do you have lots of sick days and other absences on your record? If you do, forget it because they can say they fired you for anything if you have a crappy record.

it all comes down to paperwork. did you get your FMLA paperwork completed? did you get it turned into your employer? as to the issue of discrimination was it documented? do you have wittnesses? these are all questions that need to be answered before we can give you any real advice. please add details to your question.
