Am I responsible for my dads debt after death even though I was his P.O.A. Nursing Home debt?


Am I responsible for my dad's debt after death? I was his P.O.A. for him when he was in a nursing home. He has an outstanding debt with them. I signed all his papers. He was medicaid pending, then he became a hospice patient. My lawyer said that a child can not be responsible for a parents debt after death. I signed those papers when he was still alive. The nursing home has sent my account to a collection agent. HELP!! I do not have the money for this bill. DEBORAH B

If your lawyer said you were not responsible for the debt why are you asking YA for an answer? Call your lawyer and have him write a letter to the nursing home and have him/her tell them the situation and to back off.

If your lawyer said that a child cannot be responsible for a parent's debt after death, then you need to hire your lawyer to fight the nursing home/collection agency.

I also don't believe it's possible for them to do this!

His estate is responsible for the bill. If he had a will, you should have it filed with the probate court and the executor should begin processing assets and debits for payment. If he did not leave a will you should, as his last known Atty in fact, begin an intestate estate that will have the same responsbility to settle his debits, selling his assets and distributring the left over funds according to state intestate law

It also depends on what you signed. I agree with the previous posters though - have your attorney or your dad's last known attorney look over the papers carefully and help you straighten everything out.
