I have a legal question concerning a hospital?


my daughter has been in the hospital she was passing out while we were in the e.r. i asked the nurse to watch her while i went to make a call they were aware she was fainting when i got back to her room she was lying on the floor they had not put up her rails and jumped me for leaving her even though i asked them to watch her for a minute when she was put in her room upstairs i told the nurses station i was going outside to use my cell and call her dad and to watch her she was sleeping the phone in her room was not working when i got back upstairs an lpn met me at the door and said they caught her smoking so i went to her room and found out she was not smoking she got up to go to the bathroom and past out when she came to she called the nurse and the nurse came in and said she smelled smoke and left my daughter lying in the floor while she searched her room for cigarettes then the lpn said she did not tell me she caught her smoking just that she smelled smoke she didnt even check her

my daughter is 17 years old, this kind of thing happened a couple of times her dr. was upset with the nurses and they told me 1 of the nurses with the lpn when this happened was a charge nurse but come to find out she was a nurses aid they tried to get us to leave that night but wanted me to sighn a paper saying we were leaving against medical advise i refused to do this they did not put any of this in her report and threw away the papers they wanted me to sighn

Call the media and see a lawyer

The most important issue is your daughter's health. Is she all right? Did they treat her finally? Was the issue of the smoking ever resolved?
Unless she suffered some damages there is little you can do. You could write a letter to the President of the hospital advising him/her of this unfortunate incident and expressing your outrage that your daughter was left unattended even though you had advised the nursing staff that you had to leave for a brief period of time. You might also advise that the nursing staff was remiss in their responsibilities to a patient (rails not put up, etc)
If nothing else you may receive a letter of apology.
But if she was not hurt or damaged, there is little else you can do.
If, on the other hand, she was hurt as a result of the fall, you should contact a lawyer.
