How can i find a lawyer to take my case against a hospital that hurt me while in a coma. Every Lawyer is scare


I was in a car wreck and ended up in a coma. While in the coma the doctor damaged me. Now I can't find a lawyer to take my case. When I mention the hospital where it happen they all say we fill that YES you do have a case BUT our firm can't handle it. It seems to me that they are affraid to even try. Can you give me some advice. I have another Dr. And a Nurse and my Drs. assistant That have told me that they would have to say it did not happen in the wreck. By Law.

I wonder if they are really scared, or they just don't believe your case can be won. Even if you have a doctor and a nurse who say it did not happen in the accident, there are still problems with proving up such a case. First, there is a thing called a standard of care. That is, a certain level of less-than-perfect care is acceptable, since doctors are not perfect. Secondly, the opinion of the doctor and nurse you mentioned would be pitted against other experts who might claim such an injury could have happened as a consequence of your injuries in the car accident, as a secondary thing rather than right at the time of the accident. For example, if a person has an injury and it is bandaged in emergency first aid with a non-sterile handkerchief or a scrap of fabric ripped from someone's clothes (the way they seem to do in movies a lot), it can get an infection that makes it much worse. In that case, would you expect the law to blame the person who took care of you when you got to the hospital or the person who administered the emergency first aid? After all, if they stopped the bleeding, they may well have saved your life. Sometimes there is no one to blame, in the sense of being able to win a lawsuit against them.

There are thousands of variables that go into whether a personal injury lawyer believes he has good enough odds of winning to be willing to take a case. After all, he invests his time, and often his money in costs, long before there is a settlement or a jury verdict. One of the variables, however, is how hungry the lawyer is, so if you have not checked literally every lawyer in town, keep trying!
