Well the 90 day period ends Jan 2 and what I understand i can see any doctor I wish at work comps expense. Last doctor i saw suggested me going back to work at some capacity. I was and am all for it. But when I left nothing in the paperwork the receptionist gave me had a script for me to return. Well he's now on holiday vaca.
Question : Do I hold off on this until I see him again on the 16th and wait for them to call in the interim if they are pushing the issue?
My injury is not healed and certain problems are not resolved nor has there been a definitive diagnosis.. 4 doctors 4 different diagnosis. I see andother work comp specialist on the 17th.
I really would like to return to work in any capacity. My feeling is i gotta try at least.
But I work as a nursing assistant and i'm concerned about patient care and My back or leg gives out. I believe theres too much risk for harm

You should call his office and ask for the limited capacity work release form, regardless of him being on vacation. Hopefully the office can comply without him being there. You need to do this, because the carrier doesn't have to pay lost wages if you are released for partial duty, the employer has partial duty available, and you don't show up at work.

After you do this, THEN you line up the apt to see the new doc of your choice. Likely you can sit at a desk and count needles, or do paperwork, or talk to visitors, or something like that.

Without a release from a doc, your employer will not, or should not permit you to return to work. The risk is further injury and your employer assumes responsibility as well as his insurance company.
