Can a tech college terminate you from a program if your background check isn't approved by a clinical site


I have a misdemeanor on my criminal record. The Tech College dosen't require a background check when applying for entrance into the Practical Nursing Program. After going to school for 4 1/2 quarters, which is 11 months, they want to terminate me from the program because the clinical site didn't approve my background check to come into their facility as a nursing student two days before going to the clinical site. The school did not inform any of the students that this could happen prior to this incident. They did not try to find another site for the students to go to.

You didn't state what the misdemeanor was, nor what the jurisdiction is, so I will give a very general answer.

If the misdemeanor involved dishonesty, abuse, or "moral turpitude", most jurisdictions will not license you for any type of personal care.

You claim that the tech college failed to disclose that you would have this limitation and if that is so you might have some sort of action against it for "wasted tuition". The chance of you prevailing is slim, though, since most common law jursidictions expect individuals to take some responsibility for discovering whether or not they are qualified.

You need to consult a lawyer. Perhaps the lawyer can negotiate another training course where your criminal past does not limit you.

Any shandy background you may get terminated from. Think of it this way if a school is terminating you for having such a tanted background for a program do you really think you can get a job in that field? I work at a hospital and they do background checks and if you have anything they will terminate you immediately. NO and if or buts. Your gone just like that. What I would do is seek the judge who gave you this misdemeanor and let him know your situation. See if they are willing to keep it on your personal record but exsponge it from any public record or try to have it exsponged all together that is the only way you will ever have a chance.

I would go back to the registration office and find out who you can contact to resolve this problem. Even Tech schools have someone you can contact.
