If a hospital erroneously mixes up records and states that a patients mother has schitzophrenia, apologises but too late-many copies of this report have been released and they later give a letter stating it was an error, but then a social worker gave information on the phone stating that the same person (mother) has mental health problems and has been an 'in' patient in the psychiatric ward AND STATES HE KNOWS THIS AS SOME NURSES SAID SHE LOOKED FAMILIAR AND THEY REMEMBER HER FROM THAT WARD but it was completely false-a case of mistaken identity.
MY QUESTION IS THIS -Can the hospital be sued given that a lot of damage was done as a result of their false information. Not to mention embarrassment and defamation of character. Or would the mental health act not apply as there was no breach being that the person was never a (mental health) patient at the hospital and had only been admitted there once for childbirth.
