I am being charged with a misdemenor, haven't gone to court yet, but was suspended from my job, is this legal? |
I am a CNA in a Nursing Home, they suspended me, because they HEARD that I was being charged with a misdemenor, but that I could have my job back after my court date, is this legal or fair? Yes, go look at your employee contract. Most jobs in which you deal directly with the public or have the public safety in mind as an occupation--aka Nurses, Teachers, Police, Fireman............ Have a strict "Conduct Clause". Is this fair--yes, for the safely of the public and the name sake for whom that you work for (bad press and liability). Would you want a teacher who is accused of molesting children still teaching until they are convicted. A Nurse that batters, a Police officer that is a prostitute, or Fireman that sells drugs. I'm just a mechanic now---but, If i get just accused of DUI--I'm not allowed to drive any company or customers vehicles, any forklifts or yard equipment, and I cant bring my own car on the property even though I may still have my driving rights. (because of the liability insurance they carry) If convicted--I'm fired. Do I like it--no, fair-- Yes same rules apply to everyone. talk to a lawyer You should talk to a lawyer. When you were hired, did you sign anything that said that? Is that the known policy of the nursing home? am being or have been charged? |
