If you were discriminated against because of cancer history and fired how to get another job? |
If you say you were discriminated against, no one will hire you and if you agree with them and say you did a bad job no one will hire you. I got a raise that January and a good review, everything was fine until a fulltime opening came up and they hired a friend of the boss instead of giving it to me. I complained, they gave me benefits, I went for a checkup at surgeon and oncologist. Then my boss said "Why didn't you tell us you had cancer when we hired you?" I can't prove she said that. They started writing me up on petty stuff and fired me. I was a nurse.I am over 50 too. I went through bankrupcy twice also and I think they hold that against you. I have lived on unemployment off and on for a year, but now it has run out. Even if I try to get a job as a nurse aide, they say "We hired someone more qualified than you". I don't know what to do. I am feeling scared and lost . (They have done this to other people too and they got a new insurance after getting rid of me with higher deductib The writing up was for petty stuff to cover up the firing from raising their insurance rates due to history of cancer. I got a big raise previous to that. Most places require a quarry check and a credit check, there more concerned with the quarry than the credit so that should not be a reason not to hire you. The part about applying for a nurses aid position when your a nurse that' questionable. If you need to give your old company as a reference tell the company that you are applying for no to contact them. In the interview when questioned about the reason that you are not at your previous position tell them that it is a personal matter and that you can not talk about it. As for the discrimination part of it if you can prove it go for it, or at least talk with a lawyer (legal aid) and see if you have a case. I know you may not be able to afford a regular lawyer, but maybe there are some programs like LegalAid here in PA that can help you. You may need to talk to a lawyer about this - whether about your past employer or the ones who won't hire you. They are not allowed BY LAW to discriminate. The problem is if they wrote you up, it probably wasn't for your illness. It was probably for other issues, which would allow them to fire you for cause. Then other employers can hire whomever they want, as long as they hire them without discriminating against you. The big problem is that it is hard to prove that you weren't hired due to your cancer. THey can use any reason they want, and if it is reasonable, you will not won, and you wioll accrue legal fees. |
