Would this person be legally liable? |
My friend was sponsored by Company X to come over here (US) and work as a nurse. It has been a month now, she has not started work because of the processing of the SSS, license and negotiation with the employer to amend the terms stated on the contract. Now, she got hold of her license and SSS. Frustrated, she is planning to seek part time employment from Company Y. While waiting a decision from Company X. Will this person breach any law or contarcts? Many contracts have a clause which forbid a person from working for any other employer without their consent. She should look for this clause before making her decision. If Company X paid anything or expended any costs to get her here and sponser her then your friend is liable to reimburse their costs is she does not live up to the contract. Without access to the contract, there's no way of knowing if her action would violate it. However, if she is here on an employer-sponsored visa, I don't think she's legally permitted to work for a different employer using that visa. I don't know, sorry, but I hope everything works out for your friend. |
