Attorney problem? |
My husband and I filed Chapter 13 bankruptcy in 2006. My attorney had my husband change his tax allowances on his paycheck to insure that we would not get a refund. The attorney based our bankruptcy payments on the higher tax allowances. This tax allowance level does not give us enough to pay for our federal taxes. Because of this year we will owe over $4000 in federal taxes. We are paying alot of money to the trustee weekly almost $350. That's over $1500 a month to the bankruptcy court. I believe that paying our taxes is a necessity and should have looked at the amount we would pay in federal taxes. We are barely paying bills now. I was working at the time of the bankruptcy filing, but suffered a back injury and can not work. My profession was a nursing assistant. I would love to return to work but no doctor will allow me to care and transfer patients with my back. Any advice? You can petition the court to modify your plan based on legitimately changed circumstances or you can request an early hardship discharge. Talk to your attorney. |
