I was recently random drug tested for which was supposed to be confidential but every one knows?

last week my superviser discretly pulled me aside and told me to follow him to nurses office, with just him and the nurse present iwas informed iwas being random tested,i p'd in a cup and was told i tested pos for thc, i was taken to personel where just me the superviser ,nurse ,and personel manager were there, they told me i would be susp'd due tests results from the lab.i asked them if the results come back pos what happens ,they said i would be fired.not saying anything else to anybody i went home.i later got a call from a trusted friend at the plant ,who i had not yet spoken to ,that told me she was told by a superviser ,that i admitted to the office i was guilty,this is a different superviser than was there.my friend said she also heard it from the superviser that was there the same ..to back track a little, when iasked what would happen if the test came back pos ,only the P M was there.any way i didnt admit to anything. this was to be private.are my privacy rights violated

Yes, your privacy was violated. Not sure what you can do about that, but you might contact Human Resources or someone in the corporate offices to file a formal complaint.

I suppose you could sue. But in the end even if you won that type of case, you wouldn't get your job back.

When you break the law your privacy rights do not exist. With that said you can try sueing as the employer does not have the right to pass this information around randomly to people in the plant.

You can try suing but I doubt you will get anywhere and why would you. It would just expose your crime further.

It is likely that the rumor started merely from the fact that you were escorted to personnel with the particular supervisors present, after a routine random urine test. It doesn't take much to put two and two together. The rumor gets embellished with "you admitting something" due to the amount of time spent with the door closed.

I'm just saying a lot can be assumed based on simple observation, without inside knowledge.

And of course someone may have opened their big mouth.

The more important issue is not to do things that are illegal in the first place. (I guess I'll get a few thumbs down for that opinion - sorry, just the way I was raised.)

yes, your rights of privates has been vialated, but don't forget what got you where your at in the first place. todays tech can tell if you were just sitting in a room that other people were doing drugs, what they can't tell the difference in is if your were using or just happen to walk into the wrong room

Hell yes you have a law suit! I bet you live out in the mid-west like Arkasas, Oklahoma, Texas area too! I use to live in Texas for 7 years and I know they pull sh!t like that! But if you get an attorney on their @SSES they will not only apologize, they will settle out of court and you will get paid for your pain and suffering. I live in the North now where I was born and raised. They have unions up here to take care of stuff like that but out west.......people are treated worst because it's the people who make the damn rules! The higher ups out there thinks that everyone is a dumb hick and that they'll just do as they're told. Show them that they're wrong! They couldn't handle my black northern looking them dead in the eye type of attitude that's why I brought my black @ss back home! Too many damn restrictions in the South and Mid-West! But you're human just like them. Tell them you're going to the nearest newspaper reporter or media. Anyone who will listen to you and the way that people are treated.

if it is written in your employee handbook that drug tests are confidential, then your employee rights were violated, now are you suspended or terminated? if they planned to terminate you maybe they thought that the leak would not get back to you. i would speak to the people in question and see what they have to say then i would seek legal advice to see if i could sue for deformation and punitive damages. good luck!

your on the way out, sounds like they already knew somehow that you smoked pot, you should talk to an attorney!
