Is it legal for my direct nursing supervisor to drug test me in the state of minnesota?


my girlfriend who is a registered nurse went to a year end party, had an incident with her direct supervisor, and was drug tested 2 days later by this supervisor who had something against her. It seems like a huge conflict of interest to me for any supervisor to drug test someone they are in direct contact with and i think that a drug test should be administered by an outside source. The supervisor wanted to get rid of her. She got fired a couple days later before the drug test even came back for a made up reason that she shouldnt have been fired for to begin with. When the drug test came back it was positive for a very small amount of narcotic which my girlfriend never had taken. The supervisor had to have rubbed a small amount of the narcotic in the container my girlfriend had urinated in and tainted the specimen to get back at her. Well the results of the drug test went to the minnesota state nursing board and she had her license suspended for 2 years and her carreer is ruined

WOW. That's insane.
You should definitely contact the State Labor Board. I had an issue with an employer recently and they were VERY helpful!

Good luck to you, I hope your girlfriend prevails. This sounds very serious and she should definitely pursue this.

The way the military does it is they make sure you are present from the moment the jar comes out of the box, till the moment you return the filled sample and watch as they put the tamper-proof seal on your jar.

3rd parties are always used to eliminate conflict of interest, but in reality, the government and possible her workplace, can do whatever they want in administering the test.

Your talking about your friends CAREER here, so to do nothing would be crazy, definitely talk to a lawyer and what the previous poster mention (labor board was it?) and see what options you have.

unfortunetly we have a war on drugs and this is legal as a condition of continued employment .the real ? is why. because it limits your employers liability rates and if sued and it is shown that negligence was due to the use of illegal drugs.you can be held personelly responcible .if drugs were legal we wouldnt have this problem.of wide spread testing and people would say its a violation of the constitution.unreasonable seearch and privacy issue which you gave up when no one spoke up against making drugs illegal i have no use for drugs but i do enjoy freedom and its being eroded by laws like this everyday laws protect the rich and powerful its a shame your freind is a casualty of this unresonable and unconstitutional war on drugs.if we are not watchful of government we all become victums be whare the power and control of government in your private lives
