Can I sue a govt. agency (Ca. Board of Registered Nursing, regulated by Dept. of Consumer Affairs)? |
Ruling by Superior Court: The Ca. Board of Registered Nursing (Govt. agency, regulated by Dept. of Consumer Affairs) "manifestly abused their discretion" by revoking Nursing License for 2 years. Writ of Mandate was granted "revocation of Nursing License was "manifestly unjustified". Can i sue for the legal fees, loss of income, pain and suffering as a result of not being able to practice Nusing for 2 years due to license revocation Yes.You can sue .It dosen't matter if it was a Government agency or not .If the agency in question abused their discretion and a writ was granted on the grounds that your Licence was taken away unjustifiably,you can sue for all of the above that you have mentioned pluss punitive damages.
