I am a registered nurse falsley accused of assaulting a patient what can i do to sue him?

If you are innocent (by civil not criminal standards), then you can sue for defamation if the patient made the original charge.

If someone other than the patient made the charge things are more difficult because of the protection of mandatory reporting laws.

You need either a personal injury lawyer who specializes in defamation or an employment lawyer if your employ made the charge.

I'll give this one a shot...

I am a lawyer. My wife is a RN who works in Labor & Delivery. A few months ago, she was asked to go cover for a nurse on her floor for a few minutes. Apparently, this required her to go into a room in which an expectant mother, her mother, and boyfriend, were present. The pregnant mom, who was on bed-rest for high blood pressure and on "Pit," as I know it, immediately demanded to go outside and smoke.

My wife said that she needed to stay in bed and that she would contact the doctor concerning her desire to leave the room to smoke. [This patient had already been advised from staff that the mom was streaming profanities after already having been prevented from leaving for a cigarette.]

Apparently, she then pulled her IV and ran at my wife, who is about 5'2, and happened to be standing near the door.

Of course, as a guy (after seeing she was okay), I found this story to be kind of humorous. She didn't. But she managed to not hurt herself or the patient(s) in the cause.

Thereafter, this patient filed a complaint against my wife alleging assault, false imprisonment, etc...

This is going to happen. And, unfortunately, with probably ever increasing frequency (especially w/ meth moms etc.). Just be sure to document everything -- and in any abnormal circumstance, ask co-workers to also document this stuff. Then tell your supervisor about the nutcase and make sure that futher documentation is made.

If you are serious about suing somebody under a similar situation as described above, you need to contact an attorney.

Your question indicated that you have been accused of Assault --which is a crime. It is highly unlikely that, even if reported, you would be charged with that crime (unless you left out significant portion of your story). At this point, only a prosecutor could charge you with that crime.

You could file a civil law suit against the person who accused you of assault, but the chances aren't real good that you could prevail unless you provided a lot more detail than your question here and were able to substantiate damages.

If you are serious about a suit, see a lawyer specializing in civil torts/injury.
