A lady is drving on the highway and hits a runaway horse. She sustains multiple injuries such as: partial hearing and sight loss, difficulty walking, fractured skull and facial scarring, etc. She won't ever be able to work as a nurse again due to her injuries, so 1) what area of law is involved in her case, and what does she need to prove to be successful? 2)Thus what must be done to initiate her case? I don't know all the terms or procedures, but I wonder if you can file a tort complaint alleging negligence by the horse owner and whoever else could have been responsible for the horse's escape from enclosure; whoever else should have reasonably foreseen that if that horse escaped it might run to the highway and cause a collision. in just about every state, horses cannot run loose. it is the owners responsibility to keep them within the confines of their own property. the owners would be neglient for letting the horse loose. she will have to sue the owner for damages, physical and mental. |
