How to handle malpractice situation?


on 10/30/06 a nurse called into the pharmacy a dosage of dexamethasone 10 times the amount that I was supposed to have. I read the doctors notes later and saw that the doctor wrote 0.25 large and clear anyone could have seen that. The nurse never caught her mistake and for 2 weeks I was on 10 times the amount and then on the 15th I tried telling them what happened and they didn't believe me that the first nurse messed up and so essentially what they did was put me in shock because I went from a ton of steroid to nothing and then finally on the night of the 16th the doctor finally intervened and put me back up high and then I tapered down and really suffered withdrawing from the nasty stuff. Anyway I think I have a good case for malpractice and I tried calling a lawyer and he's been traveling and I talked to him once though and he acted like I didn't have any damages because I surviv ed ( it was a life threatening situation) and because I'm disabled and don' make hardly any money. ??

what about my suffering? it's like the legal system is only here to help rich people.. if a Rich person goes through what I did they can get all kinds of damages and if it is me, on disability and they don't see anything that they can get - then they can't help me... it stinks. Rich people really do get all the breaks - they get more respect - everything is easier for them. They do get more respect..

You won't get much legal help, if they don't see a big pay day. If you don't get satisfaction from the doctor, you can still report this to the state medical board. They will investigate complaints that never get to the court room. If its justified, they may penalize him.

Since you didn't suffer any damage, you won't get a dime. My mother in law almost died from a med mix up from a colonoscopy, and she has major problems and stuff. But, she didn't try to sue and probably should have.

The attorney may be right, that damages would be based on your income so . . .
but check your yellow pages and consult a second attorney.
But be prepared, suits are pursued for damages and if you haven't lost wages (which is how they assess damages) then . . .

Re: suffering, although everyone suffers , the legal system has not come up with $$ amounts to compensate that.
The only thing they can do is relate to losses, like job / income if you were self employed and couldn't do that during that period. No one has ever set up a $$ comp chart for pain & suffering.

Lawyers work on contingency fees. So your rich man/poor man argument doesn't hold water. If an attorney turned his nose up at it, I suspect that you don't have a case.

Are you SURE that 0.25 mg is the proper dose. The supposed 'wrong' dose of 2.5 mg would seem to be more in line with what an adult would get. Typical adult doses rande from 1 to 4 mg.
