How much is a scar worth in court? |
I recently cut myself and had to go to the ER for stitches. While the cut is not that big, only about half an inch long or so, it is on the back of my arm in a highly visable area. The stitches the doctor put in unraveled within 2 days, and I had to get medical care again. The new doctor could not restitch it as it was too long after the injury, and the skin never closed properly. I have a gash, the skin is still open even though the wound has healed. I am taking the ER doctor who put in the original stitches, what is this open gash worth? I am getting married soon, and have a sleeveless dress and cannot hide the scar, which is much worst than it should have been. Any advice? Sorry, meant to say I am taking the ER doctor to court for improper treatment. If you recieved shoddy services from the ER, there is no reason you should not be able at the very least be compensated for the cost of the bill. If you went to a different doctor and they did the best they could, show a copy of that bill and paperwork as proof. Also, start taking pics of the scar to chart out it's process. It sounds like you are mad about the scar being bigger than it should be. Stitches should leave a very thin line, but if it wasnt properly closed, there is odviously a much larger scar then there should be. Also, if you stay in small claims court, you will be held to a lower standard of proof, and no lawyers are allowed in small claims. I would persue it!!! My backtought is:If your groom you thik does not merry you because that scare -do not be less satisfied than that first doctor to merry you. Oh my God I feel so sorry for you (!) go now before wedding and its worth more its physical evidence, id say its worth alot That's too bad that that happened. At least it's on the back of your arm and not the front. I would get a lawyer for this and see if they think it's worth taking to court. They will know how much you could expect for a settlement. Do you honestly think you are going to get free professional advice on here? All depends if you make your living with that arm. Careful, too, for in court though the burden of proof is lower in civil cases, so is the bar set lower for cross-examination. If you have history of cutting, or it can be insinuated, you might find yourself viewed negatively and hurt financially. Only the judge and lawyers get paid in court. I am suprised that you found an attorney to represent you on these facts. I would think that it would cost more to bring this case to trial than you would get as damages... hmmm... I dunno. If it's only a cosmetic thing, and the scar doesnt actually impede your arms use at all, I am not sure if you have grounds for court. But then again that is only a guess. It depends on the scar, where it is etc. Once the stitches unraveled did you go immediately back to the hospital to get them redone? Maybe you should think about suing the idiot who cut you. Please don't breed as we don't need anymore people like you filing these silly lawsuits. You should try cocoa butter. It gets rid of scars but I don't think you should sue your Er doctor I think it was complications during the time of your healing period. Don't spend the money yet. I have a HUGE scar that was caused by a student at University Of Colorado Medical Center, she was not supposed to be stitching without the attending physician in the room, wish I would have know that. We are not talking about a 1/2 inch scar, we are talking about a 7 inch one. I did not want cash, just an apology, did not get it. To apologize would be to say they were guilty, so I went for the pockets when it was all over with I was told to wear a one piece swimming suit and get over it, basically. The ER doctor did his best I'm sure. If you go to court and win, then ALL of us will have to pay because a doctor's biggest regular pay6ment is his/her mal-practice insurance. It's just a little scar that will get smaller. Tell your ER doctor what you're planning to do. He may offer you a few bucks out of court to settle it. If you go through with it...maybe 5 grand. Of course you'll have to give your lawyer 50% so you'll end up with 2500. The feds get 30% of that. So you'll get $1,750. The doctor may give you $2500 to just forget it. oh please, things happen. maybe you did something to make the stitches unravel. Most scars cause from a accident or in your case someone (medical) not properly repairing a injury to begin with would be look at as to amount of disfigurement cause. Damages awarded would be based on the laws of the state you live in. |
