Types of warrants?


I am positive there's a warrant out for me, but when I contacted the clerks office they said nothing came up but they were only able to check the city police and the sherrifs department.

Would a warrant be issued with some other agency? This is for traffic citations that I was on a payment plan for, but didn't pay. I'm told a summons was issued, but was out of the country at the time and never saw it. Being over a year ago I'm sure there is a warrant.

Two questions in one here... I also got another citation in a different county (also over a year old - I know I'm an idiot) and ran into the same deal trying to find a warrant on the books. I want to know as much of what to expect when I go to get these taken care of and hopefully avoid winding up in a holding cell for a day or two.

Is there a type of warrant that won't show up when the county clerk does a search? Or did I just get lucky and don't have one?

I think you did the smart thing by pro-actively trying to resolve the warrant situation now, instead of letting it catch up to you when you least expect it.

If you only called one time to a police agency to have them check for an outstanding traffic warrant, I think you should call again. If you called a small department, but live in a county that has a larger department, try calling the larger one as a 'double check'. It's okay to do this. Traffic warrants are researchable in all law enforcement data bases in your state, and often beyond.

It's also possible that the person who checked for your warrant entered the spelling of your name wrong. Make sure that when you call again, say your name exactly as it would have appeared on the citation - which is probably exactly the way it is on your driver's license - and spell it if necessary. It's also important to give your date of birth very clearly, so there's no mistake there either.

A warrant that would have been put in effect a year or so ago should be in a computer system by now. Don't rely on getting lucky.

All I can say is that the citation and failure to appear to take care of the citation should be 'there' somewhere.

And if it isn't....well, you just might have experienced the most extraordinary stroke of luck one could hope for. But I'd worry if it was me, the same as you. Who wants to get too over confident, then one day while your riding around with a favorite girlfriend and everything is so nice, you get pulled over for a tail light out and....."excuse me sir, but would you step out of the car for a moment? You seem to have a warrant for you". :(

sounds like you may just be lucky..but I would certainly check again.because you don't want to get a nasty surprise somewhere down the road

As a rule a citation is a summons to appear or pay (plead guilty) if you FAIL TO APPEAR the judge may issue a bench warrant for your arrest. This may vary by state but you should be able to find out through the clerk like you said. If you dont have the old case or citation number then go to the cop shop with cash to get your butt out. Some municipalities may be small or poor enough that they dont issue bench warrants for nonmoving or minor violations. Some places traffic tickets drop off after a period if unresolved just due to volume in the system they cant maintain the backlog.
